In 2013, the Spanish Government announced and legalized the Residency by investment program for foreigners. Applicants must be above 18 years, in good health condition, and without any trace of criminality. Furthermore, the applicant is expected to buy real estate, invest in shares or start a business in Spain.

GUIDELINES FOR PERMENANT RESIDENCY IN SPAIN

1. Document Screening
We assist you in screening your document in preparation for government approval. For this process to go smoothly, applicants are expected to make a down payment for opening the application. We guide and advise our applicants on the needed document for processing the Spain Residency application.
2. Secure Investment
We help applicants get property in Spain that meets the Government’s required investment for a residency permit. We also fast-track the property purchase document with the buyer, so we can use them to apply for Permanent Residency in Spain.
3. Get Power of Attorney in Exceptional Case
We can get a Power of Attorney on behalf of the applicant if the applicant decides not to travel to Spain.
4. Preparation of Property Purchase Documents
We help our client get the property purchase document to conclude the purchase deal. At this point, we expect the applicant to transfer the property purchase fund and taxes.
5. Prompt Update From the Government Agency
As soon as the Government has reviewed the applicant’s file, we will get notified if the Residence Visa is approved or not. Immediately the Visa is granted, the applicant may decide to stay in Spain or not. However, to get the residency permit, the applicant must visit Spain once a year minimum.
6. Approval and Delivery
Once all is done and approved, the Residency visa will be sent to the applicant through a courier. Meanwhile, the balance of professional fees has to be paid before sending the Visa.

Note: After the first year of investing in Spain, the investor can apply for approval to reside in Spain for 2 years. The approval is renewable after 2 years (continuously). So far, the investment limit of €500,000 is preserved . For an applicant to get this approval granted, there needs to be proof that the applicant has traveled to Spain once within 12 months. The 2 years residency can be renewed repeatedly, dependent on the investment rules being maintained.
Buying and selling of properties are allowed during this period, based on the fact that the investment rule is maintained.
Approval of Spain’s Residency is the sole decision of the Spanish Government. However, the application may be turned down based on the following reasons; if it is discovered that the details on the application or documents presented are false, if the applicant is associated with a body or event that would tarnish the image of Spain, engaged or investigated for a criminal offense.

COST OF PERMENANT RESIDENCY IN SPAIN

To qualify for Spanish Permanent Residency, the applicant needs to meet up to these
requirements:
a) Real Estate
Purchase of a real estate according to the minimum due amount
Minimum investment – EUR 500,000

Added Fee Include the following
These fees are to be paid in addition to the purchase of real estate:
Property Transfer Tax – 10% of property price
Property Income Tax (Annual) – Approx. 1.1 – 2%
Tax on Real Estate – Dependent on area
Spain Golden Visa – EUR 70 per applicant
Spain Permanent Residence (PR) Card – EUR 70 per applicant
Our professional fees, certificate of Citizenship, a passport, official application forms, courier, and other disbursement are the main cost associated. Notwithstanding, we will provide a detailed quotation for transparency purposes.

PROGRAM DURATION

The duration of 6 months is the specified timeframe for the residency application process.

However, the initial duration of document collection could be a bit longer depending on how fast the applicant provides the required documents. We are fully on the ground to assist our client (applicant) pass-through this stage faster with samples and professional advice.

The duration of the renewal stage depends on the availability of the agency that would handle it.

We have no regulation over this particular process. However, we assure you that we work with the best Government agencies to hasten the entire process and make our client (applicant) get quick approval.

QUALIFIED DEPENDENTS
  • Spouse of the applicant
  • Biological or adopted children of the applicant without age consideration

Note that parents and children above 18 are dependent on the applicant.

 

LEGAL GROUNDWORK

On September 27, 2013, the Spanish Government introduced the Residence Visa Law to backup entrepreneurs and internationalization. The Residence = Visa Law allows non-European Union citizens to get a Residence Permit by making investments in Real Estate in the country with a minimum amount of €500,000. After that, a 1-year residence permit is granted. This permit is renewable for 2 years and continuously. So far, the real estate investment is maintained by the applicant.
